  1. I have been summoned by Coweta County Superior court for jury duty so no work for me today, and maybe a few more this week, get paid by the court, get paid by my employer, not a bad deal. More money to throw at the Venture and getting it back running, maybe some new plastic............can't get safety chrome for these old relics anymore.
  2. I was supposed to go to court this Friday but the EX was trying to split my case up so it's postponed till feb now! I got emergency custody of the kids two weeks before school started. So now I have the kids because she decided to pack up and move to TN from KY without asking me or the courts if she could and a long list of other stuff she's been doing. She is supposed to be paying me back for INS on the kids and a contempt charge that are court ordered and to be paid by last Dec 26th that I haven't got a dime on of yet, now we have school expenses and medical stuff to it and she owes me around 6K and climbing each month with more INS premimums. She decided to move up to Indiana shortly after I got the kids and live at her grandmas house so she could be closer to the kids for the courts to see she's a good mother but is never a round to help or even in the state most of the time. She tells the kids she can't find a job but the papers are full wanting RNs, she has a RN plus a masters and can't find one. Anyway she's not having a fit about the custody in court it's the money she owes is what she's contesting and wants a discovery or a postponement. Between my lawyer the lawyer I had to get for the kids and court every year I'm tired! But on a good note the kids lawyer doesn't want them to be in her custody because she likes to hit them and treat them like dogs. This is the very short version! Thank you for letting me vent on this! I am going crazy with it all! Just glad I have a great lady in my life to help me!
  3. The ex has managed to lose another great paying job again and her boyfriend had to take her to court to get her out! So she told me and the kids she was renting a house just down from their school. I meet to get my daughter and my son stays with her for his football practice. The next day she loads up and moves to TN and I don't know till last Sunday! She told me I can't do a thing about it she's the mom and the court told her she can do what ever she want and I have to deal with it! Wrong! My lawyer got me full custody till Oct, now I just have to get her to bring my son up by Friday if not then the courts and police will take care of it. She has to be the most educated person with no common sence out there!

Washington (CNN) -- A Kansas church that attracted nationwide attention for its angry, anti-gay protests at the funerals of U.S. military members has won its appeal at the Supreme Court, an issue testing the competing constitutional rights of free speech and privacy. The justices, by an 8-1 vote, said Wednesday that members of Westboro Baptist Church had a right to promote what they call a broad-based message on public matters such as wars. The father of a fallen Marine had sued the small church, saying those protests amounted to targeted harassment and an intentional infliction of emotional distress. "Speech is powerful. It can stir people to action, move them to tears of both joy and sorrow, and -- as it did here -- inflict great pain. On the facts before us, we cannot react to that pain by punishing the speaker," Chief Justice John Roberts wrote for the majority. At issue was a delicate test between the privacy rights of grieving families and the free speech rights of demonstrators, however disturbing and provocative their message. Several states have attempted to impose specific limits on when and where the church members can protest. The church, led by pastor Fred Phelps, believes God is punishing the United States for "the sin of homosexuality" through events including soldiers' deaths. Matthew Snyder in Westminster, Maryland, outside Baltimore. Snyder's family sued the church in 2007, alleging invasion of privacy, intentional infliction of emotional distress and civil conspiracy. A jury awarded the family $2.9 million in compensatory damages plus $8 million in punitive damages, which were later reduced to $5 million. The church appealed the case in 2008 to a federal appeals court, which reversed the judgments a year later, siding with the church's allegations that its First Amendment rights were violated. Albert Snyder, Matthew's father, said his son was not gay and the protesters should not have been at the funeral. "I was just shocked that any individual could do this to another human being," Snyder told CNN. "I mean, it was inhuman." Church members say their broader message was aimed at the unspecified actions of the military and those who serve in it. They believe U.S. soldiers deserve to die because they fight for a country that tolerates homosexuality. Roberts in his opinion noted the Snyder family was not a "captive audience" to the protests that were conducted several hundred yards away. "Westboro stayed well away from the memorial service," wrote Roberts. "Snyder could see no more than the tops of the signs when driving to the funeral. And there is no indication that the picketing itself in any way interfered with the funeral itself." Based on that the court concluded Snyder could not collect damages from Westboro. But the chief justice showed little sympathy for the message Westboro promotes. "Westboro believes that America is morally flawed; many Americans might feel the same about Westboro. Westboro's funeral picketing is certainly hurtful and its contribution to public discourse may be negligible," he said. However, "As a nation we have chosen a different course -- to protect even hurtful speech on public issues to ensure that we do not stifle public debate." The ruling was a narrow one, dealing with the specific, unusual facts of this appeal. Such vocal protests at military funerals are almost entirely confined to this one small group. Roberts said on the free speech question, it was enough to rely on "limited principles that sweep no more broadly than the appropriate context of the instant case." Only Justice Samuel Alito dissented. He said the church's "outrageous conduct caused petitioner great injury, and the court now compounds that injury by depriving petitioner of a judgment that acknowledges the wrong he suffered," he said. "In order to have a society in which public issues can be openly and vigorously debated, it is not necessary to allow the brutalization of innocent victims like petitioner." The Supreme Court has never addressed the specific issue of laws designed to protect the "sanctity and dignity of memorial and funeral services," as well as the privacy of family and friends of the deceased. But the high court has recognized the state's interest in protecting people from unwanted protests or communications while in their homes. The justices were being asked to address how far states and private entities like cemeteries and churches can go to justify picket-free zones and the use of "floating buffers" to silence or restrict the speech or movements of demonstrators exercising their constitutional rights in a funeral setting. A majority of states across the nation have responded to the protests with varying levels of control over the Westboro church protesters. In Wednesday's case, 48 states and dozens of members of Congress filed an amicus brief in support of the Snyders. John Ellsworth, chairman of Military Families United, said that military protects the First Amendment rights that members of Westboro use to protest. "Gold Star families deserve the respect of a grateful nation, not hate from a group who chooses to demonstrate during the funeral of their loved one," he said. "My family has been on the receiving end of their hate and I assure all Gold Star families, this group is an anomaly and your sacrifice does not go without notice." Church members told the court they have a duty to protest and picket at certain events, including funerals, to promote their religious message: "That God's promise of love and heaven for those who obey him in this life is counterbalanced by God's wrath and hell for those who do not obey him." The congregation is made up mostly of Fred Phelps and his family. The pastor has 13 children, and at least 54 grandchildren and seven great-grandchildren. He described himself as an "old-time" gospel preacher in a CNN interview in 2006, saying, "You can't preach the Bible without preaching the hatred of God." Church members have participated in several hundred protests across the country. In 2009, the high court blocked Missouri's effort to enforce a specific law aimed at the Westboro church. Phelps, daughter Shirley Phelps-Roper and other church members had protested near the August 2005 funeral of a soldier in St. Joseph, Missouri. State lawmakers later passed the "Spc. Edward Lee Myers Law," criminalizing picketing "in front of or about" a funeral location or procession. The case decided Wednesday is Snyder v. Phelps (09-751).
  5. In Florida , an atheist created a case against Easter and Passover Holy days.. He hired an attorney to bring a discrimination case against Christians and Jews and observances of their holy days. The argument was that it was unfair that atheists had no such recognized days. The case was brought before a judge. After listening to the passionate presentation by the lawyer, the judge banged his gavel declaring,"Case dismissed!" The lawyer immediately stood objecting to the ruling saying, "Your honor, How can you possibly dismiss this case? The Christians have Christmas, Easter and others. The Jews have Passover, Yom Kippur and Hanukkah, yet my client and all other atheists have no such holidays.." The judge leaned forward in his chair saying, "But you do. Your client, counsel, is woefully ignorant." The lawyer said, "Your Honor, we are unaware of any special observance or holiday for atheists.." The judge said, "The calendar says April 1st is April Fools Day. Psalm 14:1 states, 'The fool says in his heart, there is no God.' Thus, it is the opinion of this court, that, if your client says there is no God, then he is a fool. Therefore, April 1st is his day. Court is adjourned.."; You gotta love a Judge that knows his scripture!

  8. Wish me luck I am going to court Wednesday to hopefully get custody of the kids from the ex! I have to get them out of the enviroment they are in there and take care of them. This has taken me since school let out for summer break to get to court! I hope form the kids sack we win to get them away from the abuse. Thanks!

The case came up in court. The judge asked the man (about 20 years old) What he had to say for himself. The man replied, 'Well your Honor, it was like this: When the lady got on the bus, I couldn't help but notice her condition. She sat down under a sign that said, 'The Double Mint Twins are coming' and I grinned. Then she moved and sat under a sign that said, 'Logan's Liniment will reduce the swelling,' and I had to smile.   11. The Shoe Bomber Judgment Remember the guy who got on a plane with a bomb built into his shoe and tried to light it? Did you know his trial is over? Was sentenced? Did you see/hear any of the judge's comments on TV or Radio? Didn't think so.!!! Everyone should hear what the judge had to say. Ruling by Judge William Young, US District Court: Prior to sentencing, the Judge asked the defendant if he had anything to say. His response: After admitting his guilt to the court for the record, Reid also admitted his 'allegiance to Osama bin Laden, to Islam, and to the religion of Allah,' defiantly stating, 'I think I will not apologize for my actions,' and told the court 'I am at war with your country.' Judge Young then delivered the statement quoted below: January 30, 2003, United States vs. Reid. Judge Young: 'Mr. Richard C. Reid, hearken now to the sentence the Court imposes upon you. On counts 1, 5 and 6 the Court sentences you to life in prison in the custody of the United States Attorney General. On counts 2, 3, 4and 7, the Court sentences you to 20 years in prison on each count, the sentence on each count to run consecutively. (That's 80 years.) On count 8 the Court sentences you to the mandatory 30 years again, to be served consecutively to the 80 years just imposed. The Court imposes upon you for each of the eight counts a fine of $250,000 that's an aggregate fine of $2 million. The Court accepts the government's recommendation with respect to restitution and orders restitution in the amount of $298.17 to Andre Bousquet and $5,784 to American Airlines. The Court imposes upon you an $800 special assessment. The Court imposes upon you five years supervised release simply because the law requires it. But the life sentences are real life sentences so I need go no further. This is the sentence that is provided for by our statutes. It is a fair and just sentence. It is a righteous sentence. Now, let me explain this to you. We are not afraid of you or any of your terrorist co-conspirators, Mr. Reid. We are Americans.. We have been through the fire before. There is too much war talk here and I say that to everyone with the utmost respect. Here in this court, we deal with individuals as individuals and care for individuals as individuals. As human beings, we reach out for justice. You are not an enemy combatant. You are a terrorist. You are not a soldier in any war. You are a terrorist. To give you that reference, to call you a soldier, gives you far too much stature. Whether the officers of government do it or your attorney does it, or if you think you are a soldier, you are not----- you are a terrorist. And we do not negotiate with terrorists. We do not meet with terrorists. We do not sign documents with terrorists. We hunt them down one by one and bring them to justice. So war talk is way out of line in this court. You are a big fellow. But you are not that big. You're no warrior. I've known warriors. You are a terrorist. A species of criminal that is guilty of multiple attempted murders. In a very real sense, State Trooper Santiago had it right when you first were taken off that plane and into custody and you wondered where the press and the TV crews were, and he said: 'You're no big deal.' You are no big deal. What your able counsel and what the equally able United States attorneys have grappled with and what I have as honestly as I know how tried to grapple with, is why you did something so horrific. What was it that led you here to this courtroom today? I have listened respectfully to what you have to say. And I ask you to search your heart and ask yourself what sort of unfathomable hate led you to do what you are guilty and admit you are guilty of doing? And, I have an answer for you. It may not satisfy you, but as I search this entire record, it comes as close to understanding as I know. It seems to me you hate the one thing that to us is most precious. You hate our freedom. Our individual freedom.. Our individual freedom to live as we choose, to come and go as we choose, to believe or not believe as we individually choose. Here, in this society, the very wind carries freedom. It carries it everywhere from sea to shining sea. It is because we prize individual freedom so much that you are here in this beautiful courtroom, so that everyone can see, truly see, that justice is administered fairly, individually, and discretely. It is for freedom's sake that your lawyers are striving so vigorously on your behalf, have filed appeals, will go on in their representation of you before other judges. We Americans are all about freedom. Because we all know that the way we treat you, Mr. Reid, is the measure of our own liberties. Make no mistake though. It is yet true that we will bear any burden; pay any price, to preserve our freedoms. Look around this courtroom. Mark it well. The world is not going to long remember what you or I say here. The day after tomorrow, it will be forgotten, but this, however, will long endure. Here in this courtroom and courtrooms all across America, the American people will gather to see that justice, individual justice, justice, not war, individual justice is in fact being done. The very President of the United States through his officers will have to come into courtrooms and lay out evidence on which specific matters can be judged and juries of citizens will gather to sit and judge that evidence democratically, to mould and shape and refine our sense of justice. See that flag, Mr. Reid? That's the flag of the United States of America. That flag will fly there long after this is all forgotten. That flag stands for freedom. And it always will..   12. I noticed several people are selling bikes as parts bikes because they dont have titles.I had a 1981 sr250 that had no title. The last it was titled was in Ohio in 1987. I live in Indiana. Being the privacy act I was not allowed the names on the last owner that had a title.So I tried to go through the Indiana BMV. that was like talking to a wall. The next step was to go to court to get a judge to sign so i could get a title. The cost was $130 just to go in the court room. With the chance the judge says no i did not go that route. Found a place on the internet called International title.. Called the number sent the paper work they requested. Three weeks later I had a registration and plate. This was from Maine. (legal)Transferd plates to Indiana and it was done. Some states dont need a title for motorcycles after 15 years. Just thought this might help someone out...By the way the plates and registration cost me $140 through International title.

Well today was the pretrial hearing....The judge decided we would handle the pretrial tomorrow along with the motion hearing......so nothing happened. well about 5;15 tonight i got a call from the prosecutor.......... the perp accepted the plea ...and 18 years,which is what we offered.( hes 55 or 56 now) This is cause for major celebration..!!!.......no trial...no haylie having to go thru it all over.... ive been sort of numb ever since the call.....im happy, im sad.....im relieved.....i just cant explain it. ive cried......ive smiled....ive laughed. tomorrow at the hearing he will give his guilty plea.......the prosecutor is going to to try to get the entire thing settled tomorrow......the sentencing included so its done..over...we're outta here! if the judge doesnt oblidge us i imagine we will be back in about 6 weeks for sentenceing . he did let us know things can sometimes fall apart between plea and sentencing when the judge orders an assesment......the reason being because he has no prior criminal or any kind of record......the only thing they will most likely turn up is that he is a drunk...so this could sway the judge to lower the sentence.....or some other dumb thing.......so we're pushing for the whole shebang. i like to think "its finally over"......dale wont say its over til he hears the sentence..... but he will be a registered sex offender........would never be allowed to move back here as long as we live here...... plus he gets to relive what he did over and over when bubba gets ahold of him and hes walking around with his thumb in the front of someone pants...and becomes his b****.. haylie will be attending court with us tomorrow as well as some of her BACA family.....she still just doesnt grasp the court and everything thats happening.....but i believe being there for this tomorrow will be a help in her life when she understands it all. To knows she was a part of the end where there was some justice and not just a bystander. ok let it rip...................................... alleluia............... yee haa............ woooo hoooooo:cool10: I will fill ya all in tomorrow after court.......10 am:D
  15. well the sheriff dept was just at my door delivering my new subpoena for the trial..( july 20).....weird thing is dale got one too this time:confused07: and he didnt for the first trial date anyways gonna be quite a week here for us........ we finally had to sit down last night and talk to haylie - who has pretty much gone on with life and being a kid and not remembering what happened every day--we had to start explaining court and everything because tomorrow afternoon we have to take her for her first meeting with the prosecutors so they can start getting her ready for trial.....she was a little shocked about it.... well thats tomorrow......thursday morning is the pretrial hearing at 9 and fri morning is the new motion hearing at 10 that i have to testify at i have flat out decided that if there are any more postponements im gonna start having a fit...i will tell the prosecutors tomorrow that if anyones tries to delay any more that we refuse to be in that court the first week of august that we will not allow him to ruin our vacation to the rally along with everything else hes done.....so they better make sure they say something about those dates if anyone wants new dates again.....uggh its time to get it done......:buttkick:and my bloods starting to get fired up:whistling: once upon a time we had planned to be all done with this when we came to MD and would have had something to celebrate........well now here we are again.......im planning on having something to celebrate at the rally now:cool10:
  16. well my hopes that this would never go to trial have ended.....i am so angry that my little girl is going to have to testify in court about what happened to her and doubly angry that when she testifys her father and i wont be allowed in the court room. I guess the only good thing about it for now is that there are no more court dates til April.... and yes I know I should be thankful that he is going to be tried....but I hate it yesterday he filed a motion to suppress his statement ( his admission of guilt the night he was arrested) and to suppress all physical evidence........HA.....yeah right.....im afraid I will be on a witch hunt if they allow this. well heres the record from todays hearing...... 12/18/2008 - Hearing Held State by APA Blair; Defendant in person in custody and by attorney David Johnson. Case set for Jury Trial. Defendant ordered to appear 6-1-2009 at 9:00am for trial by jury. Defendant ordered to appear 5-14-2009 at 9:00am for pre-trial conference. Motions: State and Defendant instructed by Court that all pre-trial motions, with briefs in support thereof, must be filed no later than 4-17-2009 at 5 p.m. If pre-trial motions are filed, the motion hearing date is set for 4-24-2009 at 9:00am, Defendant ordered to appear. Court informs both parties that any motions requiring more immediate attention (i.e. related to bond or to discovery) will be heard by the Court as noticed up by either party. STA/plh i dont know how things work....never ever dealt with anything like this or court at all for that matter.....maybe they will try to plea bargain yet or is that out of the question now that a trial is set? I cannot let him off but i may be willing to lighten the sentence a smidge to not have to go thru a trial. The prosecutors office told me yesterday he is facing life....may he rot.
  17. but the judge ordered it !!!!!!!!!!!!!!!!!!!! it being the DNA swab........ could be a while for the results so keep the prayers coming that we get a match !! back to court next month where most likely from what was said today his lawyer is going to try to get his admission to what he did that night when he was arrested not admissable in court.
  18. Well noone let us know but I was looking at the court records last night aand this suddenly appeared : Docket Entry:Bndover Circ-Waive Prel Hrng Text: State appears by Asst. P.A. Defendant appears in person and by attorney. The Court finds that Defendant has been advised of his/her rights & enters a valid waiver of preliminary hearing; the Court orders that the Defendant appear and be present in Division One of the Circuit Court of Clay County for arraignment. Associated Docket Entries: 11/04/2008 - Hearing Continued/Rescheduled Associated Docket Entries: 11/04/2008 - Hearing Scheduled Associated Events: 11/18/2008 , 09:00:00 - Hearing apparently he waived his preliminary hearing and we finally have him in the circuit court....new judge, new court room ( finally in criminal court ) Of course i plan to call prosecutor today and see what they have to say. This means we can get his dna ordered........ if i understand right ..he now gets to make a plea again next tuesday..... if he pleads not guilty again....we start moving on to a trial...... I intedn to find out if there has been anything said about a plea bargain at all..... I really wish it wouldnt have to go to trial but with a plea bargain we would have to give in a little and that would be hard to do I also had to laugh....as i was looking thru the cases for the 18th in the court div we had been in...lo and behold shows up his sisters name ( the mother of the girl Haylie played with at their ( his parents and his) house.) Anyways looks like she is in a lil trouble herself.....Possession Of Up To 35 Grams Marijuana pretty ironic a brother and sister both in court the same day---------need i say more??? :rotfl:
  19. hard to believe its been another month already...... time for another court hearing tomorrow morning...... wonder how months this will go on before something happens?? I did find out something last week that kind of upset me....i asked the detective handling our case if there had been any dna testing done from H's clothes, swabs, etc just in case this goes to trial.....NO..he said he goofed up by not doing it ( on the perp) the night the guy was arrested..now its in the hands of the court.... I simply wonder why they wouldnt order it now ( just in case) instead of waiting months down the rode if theres a trial and then having to wait months more for the results?????????? Why not have it done and ready?
  20. leaving shortly for court.i dont think anything significant will go down today...i believe its basically for him to have to make an apearance...im kind of notted up with the thought of seeing him for the first time since that night and i hope Dale is able to control himself when he sees him. Probably no real reason for us to be there other than the fact i want him to have to see us.....to see the looks on our faces.......to feel our presence....i imagine they will set a court date for his bond reduction motion. let ya all know what happens.
  21. what exactly does it mean that the guys attorney has file a Motion for Discovery ? he also put in a motion for bond reduction...... i keep checking the public court records daily to see if anything new shows up and these entries were added to the record yesterday.
  22. earlier, i read a post about the 5-4 supreme court ruling on the second amendment. now , after an hour of reading 200+ years of "pro and con" high court rulings and interpretations, i can't find the post, so i can't reply. it must have gone SOUTH, really fast! at any rate, it is sad indeed, that we have FOUR supreme court justices, who cannot read "plain English"!!!! just jt
