You are going to find that if you go to court (And you are within your rights no matter what anyone else says) That its not going to be a clear cut case of whether it was the business' fault or yours. Whats going to happen is the lawyers are going to start arguing over the percentages of blame involved. What percentage was the gravel/and owners fault, what percentage was your fault, i.e your age , your riding experience, was the bike too big for you etc. And finally the Lawyers will go after Yamaha and include them because motorcycles are inheriantly dangerous machines. After all the arguing and cases brought up where motyorcycles were involved or how many bikes went down there and witness to such etc. the court will then decide how much responsiblity each party had to the incident. You will be given some portion of the responsibility and that percentage will be deducted fron the other two parties. What you will recieve will be based on that and your lawyers cut. Many times big out of town lawyers look for these cases because they can get big money out of Yamaha ( or any other motorcycle manudfacturer)and or the business' insurance company. Then there will be appeals until a settlement is given especially if its big. If its small it will come alot quicker because everyone will want it over. I speak from personal experience having watched a good friend go through a tragic accident where in his wife and son were killed in a car accident. His wife who died was awarded 25% of the blame because she was making a u turn when she was rear ended by a 17 year old going 25 miles over the speed limit. The impact propelled her vehicle right under a passing tractor-trailer truck ripping the cab top off her pick up truck. That was 19 years ago. Remember there will be enough blame to go around. Its something to keep in mind as you move forward.

First off. i had a slow drop too in a construction zone. Not alot of gravel just one good sized rock that I managed to hit dead on . The bike rolled out from under me and before i knew what was happening i was on the ground. Busted mirror wounded pride and a 6 in, fabric burn in the inside of my Champlain leather bomber jacket.The outside wasn't even scuffed. A few years before it was a near miss with a deer. I when through a 6 month peroid each time with a heightened sense of caution. It was uncomfortable to ride that way but i pushed through it and regained my confidence and comfort level. i'm not sure how long your period my be but if you love to ride then it will pass. To Romtom, Having just gotten back into riding and on an older bike a trike might be too expensive. but a Voyager kit , A set of outriggers that make the bike into a trike might be just the thing for you. They look good and can be removed later if you want to go back to a bike. But it would allow you and the wife to ride together again. Personally that would be a big motivation for me. Pot stirrer? more like big ol teddy bear if you ask me! Hey the ladies went easy on you last Night I think. All kidding aside( if thats possible), Rawhide( Joanna) and i had a great time an the short drive down the thruway was well worth it. Especially to be with such a great group. As far as the left overs go well we'll just have to come back to finish them off. I mean I ate my share I had heartburn all the way home. But a glass of Lactaid and i slept like a baby. Thanks again Tom and Vicky for a great time and to all there that have shown us what a great group of friends we've found on Venture Riders. And On the outside chance that you might see this Don thanks for putting together a great Forum. Phil ( PJ)

Let me just add to what James said. We all had a great time despite the crowd not being as big as we thought. Tom and Vicky were great guests and it was great meeting James, Alice, Bob and Becky and Ken . It was good knowing that New York has such a great bunch of like minded riders here the coming months are going to be a ball. Thanks Tom and Vicky for being great Hosts and thanks everyone else that showed for being great people and becoming new friends. PHil & Joanna

Hey Marcal, I was wondering if you guys are going to the Supershow in Toronto? I've been several times and its a great way for motorcyclist to get together in winter. If you are planning on tgoing I thought it might be nice for some of us to get up there meet with our northern brothers at a great bike show. i normally stay at the Holiday Inn Airport which is just a couple blocks away. Let us know. Now back to friday.It should be a fun time. Unfortunately my brother Alain won't be able to make it friday as family obligations will have him busy but you'll all get to meet him soon enough. Like Tom said we're planning three get togethers this summer and for any out of towners North, South , East or West we will have more details including accomodations for those coming from far off. Hope plenty will come.

the kid is riding a brand new 250??? Sounds like a young man on his new bike its not like he was someone riding something bigger or knarly. Not that someone on a small bike can't be dangerous but a 250 Ramming a Car???!!! come on! Oh and the kidney thing , my girl friend has stage 3 kidney disease and it doessn't affect the mind or judgement for her it was a symptom of misdiagnosed diabeties. -

foot pegs on a venture

I've never had floor boards so i can't speak to that but being a touring sport rider for years i always liked pegs because usually they were under me so I could stand on them over rough road. i also could put pressure on them to help shift my weight in a turn and get some added control. Most boards are in front of you and don't let you leverage as good as a peg will let you. -

I guess when its all said and done we should be able to express opinions or share information without being offended ,especailly if we are sharing real varifiable information. I love coming to sites like this to learn from others. We are a multi national culture and in many ways its our strength as a country. I like the more homey nature of some of the southern members always welcoming and treating you like long lost family. I also like our Canadian members that almost always have a cool head about things . I've heard horror stories about other sites and I hope we never go there. Maybe this is just a symptom of something else and we here are merely witnessing how its affecting our little group which is nothing more than a microcosium of our county(s) as a whole. I hope we don't lose the ability to talk to each other with civility and respect.Its what we should always be doing with each other. Its what makes communitcating and discussion so exciting and a learning process.

Snarley You are absolutely right. I feel I may one of the offenders and for that I apologize. I guess at time when trying to educate its can easily turn into preaching. I hate being preached at so i have no right to do the same. If i have offended I apologize and promise to do my part to keep this sight a place i will always want to come back to. I've made too many friends here to want to screw that up.
