I made a run to Walmart to get some beer about a mile from my house. I was leaving the parking lot in front of

the entrance and a car came flying out of the parking isle. They would have it me if I didn't lay it over. Luckily I was going slow enough it didn't see any damage except scrape up the guards. I'm ok. The worst part though is they looked back and saw me on the ground then hauled butt out of there. I got a police report but they said there wasn't anything they could do because of the private property and them not actually hitting me. Thankfully my beer is OK and still cold now that I am home.

 

Now when I idle in neutral I can hear some "transmission" noise. If I pull the clutch it goes away. Any ideas? Is something screwed up?

Like Kbay said, Glad your ok and there's not much damage to the bike.

 

Is there a chance that this noise isn't new but just noticed now that you're more "sensitive" due to the accident?

glad to hear that you didn't get hurt, you said that you had some scratches on the guards, you shouldn't have hurt anything inside, i'm assuming it was on the left side,

Thanks, I'm glad I didn't get hurt too! I just started it up again and I don't hear the noise. It sounded like it was low on oil or something so maybe it had to settle.

 

I still can't believe that they didn't break any laws since they never actually touched me. That's pretty dumb, if I went all the way to hitting them I'd be in some major pain right now.

How is a Wal-Mart car park private property, when it is open to and used by the public?

If that happened down-under it would be as good as if it was on the highway.

A shopping centre car park (open to and used by the public) is a public place and governed by the same rules as out on the road.

 

Just my 2c worth.

 

More importantly, glad the holy trinity is still in place - you, the bike and the beer (in that order.)

Parking lots are generally private property, owned by the store, even down under. In the US, the official rules are different and can vary by state.

 

I'm from England and I know that even if someone hits you in a car park, it can be tough getting a cop to issue a ticket!

Glad to hear you are ok and the bike is not damaged. The noise you are talking about is a common noise the RSV makes. Both of mine made the same noise, it's nothing to worry about.

 

I remember a thread last year about it either on this board or the other one, and once everybody started listening for it most heard it. Nothing to be worried about.

Hey Daryl , I cant figure it out ,you go to buy beer , somebody

cuts you off , you drop your bike ,they speed away, Now Ive

got it , while you were loading the beer into your bike ,one of the

guys in the car distracted you , stole your beer , drank it, knew

they were drunk ,sped out of the lot causing you to drop your bike

,while you were cleaning yourself off they snuck back & put the beer

back into your bike. Yup thats it ( by the way dont drink the beer they

could have messed with it )

only typeing this cause we got another foot of snow yesturday &

I cant even get my bike out of the garage & Ive got PMS

Your obviously confused about what is "Public" and "Private". A simple rule to follow is if t is Government owned then it is Public. if it is privately owned then it is Private.

 

WalMart is a private company as in not owned by the Government. This makes their parking lot private property. This is pretty much true for all businesses parking lots with a few notable exceptions. In MN we have some Municipal Liquor stores. Since they are owned and run by the municipality their parking lots are Public property.

 

Since streets are built and owned by the Government they are public. There are private gated communities that have paid for and built their own streets and therefore those streets would be private and typical not patrolled by the local police unless paid to do so by the owners of the gate community.

 

What you and so many others (including many Government officials) fail to understand is that just because I own a business and I allow members of the public to enter my store to conduct business with me this does not make my store PUBLIC. Many Local, State and Federal regulations and laws trample this fact including the latest rash of smoking bans.

 

Now back to your regularly schedule thread.

I'm pretty sure that will be the last time I make a beer run to Walmart. There are other places and I'll spend the extra $1 or so for safety. That's pretty much the only time I take the bike to there.

 

I didn't feel bad last night when it happened, but I'm pretty sore today. I guess all the tensing muscles and such did a little number on my "aging" body.

 

The more I think about it the more angrier I get. People like that really don't deserve to be here. Either they were too stupid or self centered to care about anyone else's safety. Which ever one it was they are just a waste of space. Even when they saw me on the ground they didn't care enough to stop and avoided being caught and held responsible. What would have happened if that was someone on foot or I had reacted a 1/2 second slower? Someone would probably be dead! Something like this is not an accident it's straight negligence and would have been avoided if they didn't have their heads in the butts.

If you got the license plate, you may still have the ability to sue in small claims. This may be a civil matter, and you might look into it. Just because the cops arent interested, does not mean you cant go after them in civil court, for your actual damages.

 

You need ID, you need proof, and you need witnesses....failing all of those, your screwed.

Shopping centers, including big box stores, are some of the most dangerous places to be on a bike. People are in a hurry, distracted, and sometimes confused, not to mention, yakking on the cellphone. Sometimes the traffic is coming from many directions, and the cagers are just plain rude, careless, incompetent, or all three.

 

One technique is to go in to the Wal-Mart on the less used truck entrance, or the entrance for the automotive area, called TLE. You still have to be careful, but that is one option. Park near the Tire Center, if it has one, and use that entrance. Normally less traffic, and sometimes the auto techs are outside, or working in the open bays, and they would tend to notice anyone messing around with a bike. The main parking lot is a bad place to park your scoot, anyway. Assuming the clerk in the auto center is old enough to sell you your beer, use that one to pay out, and go your merry way.

 

Works pretty good for me!

I have all 3 of those, but I don't have proof of who was actually driving the car. I don't know what I could sue for though. So far the bike seems ok, a little scratched up but otherwise ok. I don't condone taking them for what they have just because you can, even though they probably deserve it. At this point it probably wouldn't be worth it, but I'd love to teach them some kind of lesson.

Yep...I was only referring to small claims court, where you might have some chance of recovery of your actual damages...trying to get a lawyer and go after some sort of punitive award is pointless, and no lawyer would touch that.

 

Its known by the technical term: "S**T Happens!"

Glad you and your beer are ok.

 

All of you are right about parking lots. When we had our covered bridge ride I saw morgandw almost get pasted by a car backing out of a spot.

 

I think it's best to stay extra alert in parking lots. Perhaps pick a place to park that is less traveled.

When I was a cop, we learned the difference between Public roads, Public access, etc. I was in MI, & we could enforce statutes on Public Access Property [handicap parking, speeding, etc.].

 

These laws vary by state.

 

Now, I'm in KS, my wife's car got side swiped by a truck, but not a 'Hit & Run'...because a school isn't considered 'Public Property' [wondered who owned the public school].

 

There was a witness who wrote description on truck, driver & tag number, time.

Owner of vehicle is responsible, unless it was reported stolen at the time.

 

The owner's insurance company sent us a fat check, but driver could not be charged with anything since Public school is not considered Public property in KS. [??]

 

Insurance settlement for parts & labor [decent bucks] could possibly be recovered with a couple calls...owner & insurance company, since diff rules apply. Bikes just don't fall over while driving in lots.

I believe every state has some remedy for this type of situation.

 

In my case, I stayed on yokel detective's butt [working with witness info only] for a long while to get owner info.

Options:

1. Complaint with dept against cop [effective].

2. Thoughts of attorney.

3. Persistance in spare time.

 

I got estimate from dealer to fix, $800.00

I cleaned off rubber marks from white fender & looked like new.
