Yup! He is trying to scam you or something! He admitted it was stolen and supposedly has police report! All it takes is a copy of the police report, and HE could go to jail...

I would be pro active.

Call the local police to see if a report was filed, if it was, then get a copy for your records.

The Police report would be proof that you had the package delivered and he lost it after it was in his possession.

 

That and the delivery conformation from UPS should get you off the hook with PP.

 

The catch that you have to watch for is if he paid PP using a CC. , they can pull the money regardless of what PP thinks. If the CC pulls the money from PP, PP will pass that loss on to you. If he files a complaint with his CC company the CC companies are even more generous with your money than PP.

Google and Google Maps is a nice tool

 

Regarding the "gate" fence, it is 20-30 feet from the open road and house looks to be over 100 feet from there. (Google street view, even see owner at garage.)

Residence is listed on real estate lists as over 2 acres, and puts the gate out of view to much of the yard.

The fence is see-through with a simple open board fence for the yard.

A package dropped over that gate is looking to be stolen by simply stepping through the board fence.

having been in the shipping of car parts business since the late 70's let me say this. As the shipper call UPS and start a claim. If they say they have delivery confirmation, dispute it! tell them you need proof of delivery. If they don't have a sig they will pay. Up to the insured amount, they will require proof of replacement value (use your e-bay listing and others) it may take 3 to 4 weeks, but every time they claimed it was dropped they paid me and I shipped dozens of packages a day.

I would forward that message to Pay Pal!!! Sounds to me like he couldn't afford the loss and is hoping to swindle the cost out of you or it was never stolen in the first place and he is trying to get it for free! I would file a counter claim against him...

I live fairly close to Inverness, about 30-40 minutes. From that google earth, it seems that there is not any REAL reason to be down that raccoon court because I don't see any other houses, again from the google earth provided. He stated this:

Hey, that says it was an issue AFTER it was delivered. Was this the UPS driver first day or a seasoned 13 year veteran? I have never heard of UPS

1- dropping it over a fence such as it shows

2- drop off anything at 9pm.

However if it was confirmed that is was delivered, regardless of time, and there was no request to sign for it, then IMHO, your job is DONE!!!

It will suck if PP keeps your money, but like the rest +1 on being pro active and doing your own leg work with a paper trail to provide PP to release your funds.

UPS and FED ex drops packages at my doorstep and my house is a good walk back from the road, never had them leave anything anywhere else unless I sent permission in advance.

He owns an audio business that installs systems in churches.... Do I tip my hand and tell him I am a pastor? Ha! He has a website. So, I am sure he gets audio gear shipped to his house often. Maybe someone thought they were stealing audio stuff. If I owned an audio business and had stuff shipped to my house I would ask shipper to require a signature. It was dropped off after 9 pm as I have tracked the package.

Since he knows it was delivered your part is done. It is now an argument between him, the person who ran off with the package and UPS. The package was stolen from him not you. You have no obligation to insure it beyond delivery.

 

In the future send UPS 'signature required'.

 

As a side note I am left with a lot of questions. Package dropped over a fence? Why? How did the person who ran off with it get over the fence? How does the recipient know UPS dropped the package over the fence? ETC etc etc.

This information wont help in this situation, but as a recipient, it works well for me to have ALL packages, no matter the carrier, deliver to my PO box...not my home address, since I spend so much time away from home.

 

Some vendors won't ship to a PO box, and some carriers like UPS and FedEX wont deliver to a PO box...so the way to get around that is to fill out the simple form at the post office that declares your PO box as a street address. Presto, problem solved.

 

It's called Post Office Street Addressing.

For any of you who find home deliveries an issue, this might be the solution.

 

Small PO boxes are usually around $40 to $75 per year, depending on city location and size of the box.

. It seems pretty sure it's not your problem...rather the buyer's!

 

It sounds like you have proof of delivery...so it should work out to your benefit...but PLEASE let us know.

Bottom line you have proof of shipping & proof of handoff to the carrier. Since it's not a damage claim or a claim that you did not send what you sold. The liability is out of your hands. Ebay will ask you for proof of SHIPPING. If the UPS # shows delivered, the issue is out of your hands & it is between the recipient & UPS.

UPS leaves packages on my porch as well & I have NEVER given authorization for them to do so. They do this for THEIR convenience.

It may well be that someone followed the UPS truck waiting for such an occasion, we've had several arrest in Tampa for that behavior. your client may be honest you may be honest UPS may be honest that is what insurance is for.

The money was taken out of my account but the buyer has to prove his point with PayPal before he is refunded. If PayPal rules in my favor the money is returned. I filed with UPS and we will see what they decide but I believe I have a good case for PayPal. He owns an audio business that he runs from his home which may make him a bit of a target.

He is running a business from his home and UPS dropped the package by his fence? What does he do? Keep the fence closed during business hours? On a day he should have known the package was arriving? OK I feel for the buyer getting a package ripped off But UPS shipping information provides the delivery day. UPS usually delivers to businesses first. So why wasn't the gate open for them? Has UPS never delivered to this business before? I am sympathetic to both the seller and the buyer in this case. Not so much to the thief or UPS if the gate was open.

I work for U.P.S.. And I can tell you from experiance, even tho people have been known to follow our trucks around and steel packages when dropped. Our guys try very hard to make sure the packages are left in a safe place. Usually a well lit area and very close to the door. Looking at those pictures, I cannot imagine one of our guys dropping a package off that far from the house or that close to the road. Possible it was a new guy, but even then we have a very rugged training program and even 30 year vets are required to go over policy procedures weekly. I know this is a fact because that is part of my job. UPS is 106 years old this year, and they do every thing they can to do a good job for their customers. Contact them and Im sure they will do all they can to help if ya need them to

Hey ups drops/throws all my packages over the gate and onto my porch. I don't blame them either because my red heeler is not gonna let them in the yard. That could also be the reason I've never had a package stolen. Of course when she was younger she would tear the package to shreads. Thank goodness she out grew that. Any way it seems to me the loss is on him.

The buyer asked me to file a loss package claim so I did. I haven't heard anything.
