If he has been running this scam for a while he already knows that the court will back him up since there is no completion date in the contract. Now if you can get him to make one of his promises and then add an appropriate amoount of time to allow for bad weather and get him to put it in writing. Then you would have a good case for court armed with a quote from another reputable contractor to finish and/or fix his work. It might be a good time to pick up one of those spy video cameras that look like a pen in your pocket to have proof of the conversation. The moment he is either done or you have written him off I wold start contacting the BBB and any other local similar organizations. Might save someone else from his BS. Or just tell the Warden "he is all yours" and walk away.............

DragonRider Posted August 4, 2011 #117 Posted August 4, 2011 Charlene has been wanting to fence in the yard ever since we bought this house, well we finally did it. Got 2 estimates, they were about $1200.00 apart so we went with the lower. They started yesterday, 2 Mexicans showed up with the owner at 8:30 am, he showed them where it was to go and left. By the time I got home they had hand dug all the post holes and planted them in the cement and were running the stringers. Had all that done and left aound 5:00 pm. They came back today and finished it just as I got home from work. They did an awesome job of putting it up, my yard is totally downhill and the fence is perfectly sloped. The gates work flawlessly. The owner just called to see if we liked it and of course we did. We asked him if he would be coming by this evening to pick up his check, he said no, I will pass by Sat. morning and pick it up it thats okay with us....................I would reccomend this company to everyone. First class job. And they even trimmed some trees for me that I hadnt gotten around to....................

Then you can take the puke to court and get some of your money back, take picks of what has been done thus far for evidence should it go that route

Get your moneys owed and set a date when you want it in hand and have something typed up for him to sign. Include your start up moneys and what is owed to you and tell him to get it now. Go ahead and type it up and have it ready and have a witness/neighbor come over and sign if possible, or call the law and have them present. It is that simple.
