You caused the crash that resulted in his death and the injury to his wife. Side fatality By Dale Quinn Arizona Daily Star Tucson, Arizona Published: 10.23.2007 An 18-year-old man was arrested after he slammed into a motorcycle Sunday morning and killed the rider, according to the Pima County Sheriff's Department. Emillio James Martinez, of the 4300 block of East Ocotillo Desert Trail, was booked into the Pima County jail on suspicion of second-degree murder, criminal damage, a marijuana violation and a drug paraphernalia violation, according to jail records. He was booked Sunday afternoon after his release from the hospital. Martinez suffered minor injuries in the collision, according to a Sheriff's Department news release. Martinez was speeding eastbound on East Valencia Road about 4:15 a.m. in a Honda sport utility vehicle when he rear-ended a Harley-Davidson motorcycle driven by a 53-year-old man near South Alvernon Way, the release said. The man — whose name has not been released because his relatives haven't been notified — was pronounced dead at the scene. He was not wearing a helmet. Alcohol, drugs and speed played a part in the vehicular homicide, according to the release.

This is the second time I've heard of second degree murder being charged for this type of killing.
