The fact is you would not have gotten injured had you followed good common sense, said no that is not safe, used the proper lifting methods, got help, wore the proper protective equipment, asked for help, or used the right tool. If you had communicated better and evaluated the risk before you took action. How can you be so presumptuous as to feel you know just exactly what happened? Though I can't help but agree with you on just who is at fault in many instances. But then every instance is different from the next. And there are definitely exceptions to the rule. To simply close your mind and say it is the injured persons fault is ignorant. Now if your restrictions or limitations say that you should not bend, twist, climb ,turn, or lift, carry or hold a certain wieght then you should not be riding a motorcycle. That is just enough for your company to fight your claim and get it thrown out. By the way many companies hire private investigators to take pictures of you while you are doing things you should not be based on you restrictions and claims. So do not be suprised when you walk into court for you final hearing and see pictures of yourself doing activities that you should not have been doing. Still, very presumptuous. For those of you abusing the system shut the &*()) up and get back to work! Stop Screwing the rest of us! Now that I can agree with.

To many pencil pusher are running the system and not listing to the doctors. On some injures the longer you wait to treat the less likely you are to recover completely scar tissue and calcium forms and at time in place that are not operable. I feel this is how the new health system will be then other might under stand what it like dealing with workers comp. As far as WC sneaking around to take my picture I welcome it I am on video all day at work and was on video when injured you could see me arguing with the boss over this I finely gave up to save my job and did as told. I have nothing to hide As far as telling your boss some thing is not safe, in the economy we have been in the last 3 years you do what you are told if not you could and often time do get fired employees are a dime a dozen and I work in a state that can terminate at any time for no reason ( at will state ) your state is probably different I RIDE BECOUSE IT ONE OF MY LAST ENJOYMENTS IN LIFE
a1bummer Posted April 16, 2010 Author #28 Posted April 16, 2010 Wisconsin is also an "At Will" or "Open employment" state. I always laugh when I hear someone say they have "job security". There are many other things I found out over the years about the way the system works here. Things like, an employer doesn't have to pay you what they told you they will when you get hired, as long as it's at least minimum wage. And if youy employer sends you out of state to work, you can screwed on your overtime as well.

Granted, there are many Things which can't happen with proper care, but calling those out who suffered Injuries even while everything was taken care of despite all these Measures is just cold. Isn't this Insurance existing for said Reason ? I'm not going to say, to me it seems like you have the Thinking of 3rd world Dictator. My Hats are off to those who can stand the voicing of such Theories.
short-haul Posted April 16, 2010 #30 Posted April 16, 2010 yep Texas changed there WC laws about 8 years ago now they have a formula for everthing since I came back to work in 2 day with restrictions ( I felt I owed it to the School District since I was the only technician and had been here5 years) The comp doctor said nothing was seriously wrong. He made this assumption with out any tests or even touching me.It has been an up hill battle ever since.The state Doctors evaluate me 6 months later he sent me to another doctor a few thumps to my ankles and a drag across the bottom of my foot and then sent me for 3 x-rays which turned it to 16 the same day.Next day was sent for MRI and the damage was very plain to see. Was sent to surgeon the next week who suggested shots to start with to reduce the inflammation(and then wanted another MRI) WC said no not in the formula (I Guss) since then Dennie Dennie Dennie 15 months later WC sent me to another doctor for second opinion and he agreed with the surgeon shots and then probably surgery it like a waiting game Wish I lived in a different state Texas is the worst for WC claims and a lawyer will do no good in Texas.

Now for those of you talking about taking all of the pain medication what in the love of god are you doing, riding a motorcycle or driving for that matter. that just further proves you inability to make good decisions based on risk to you and others. Quite often if you have a legitimate injury, but do not follow the restrictions placed upon you verbatim then you will risk losing your case and employment. For those of you that have a legitimate case be patient, follow your restrictions, be constantly aware of what you are doing as to now cause question or doubt about your condition. Sometimes Because of the cheaters a system that used to be designed for us is now skeptical. For those of you abusing the system shut the &*()) up and get back to work! Stop Screwing the rest of us! By the way I was in the trades for 17 years before I became a safety professional, before that I was an honorably Discharged from the US States Army. This is one of those threads that is just like politics. One persons ideals of how things should or shouldn't be handled against anothers. .
