Not gonna say true in every single case, but just hear too often of the ones the ins. co drags their feet on or don't pay.

 

I am sure I have posted the one previously about my friend who had to sue his ins. co. to get anything even though he had a letter from them stating it was not his fault. They later tried to say it was his fault and they weren't going to give him anything. After he got a lawyer and after the surgeries and what not, ins. co said they will settle for $2500. They gave the ins. co. the letter and ended up being from a claims supervisor. Settelment went from $2,500 to $25,000. Especially if you have a letter from the company no way in the world should the company try to come back and say it is your fault (despite what the letter says) and we aren't gonna pay.

 

Another ins. co. is giving my niece and her fiance a hard time when their house got broken into a few months ago. They gave a sworn written statement way back when this started and now have to do a disposition this week. The ins. co. is focusing on them while the cops are suspecting his ex-wife and her brother (who has a record). Funny enough ex-wife turned in one of the items to the ins. co. and no one has been arrested yet but cops have suspected them since the beginning.

 

They lost 12k, they talked to one lawyer and basically even if they get 12k, lawyer pretty much takes most if not all of it. I told them to talk to another one. Dad said tell the ins. company anything you need to know is in my 1st statement and refer to that. Fiance called the corp. headquarters and apparently it is in their contract that have to cooperate fully or claim will be denied. Also the ins. co. has 60 days to make a decision or else they have to pay up. Well 60 days is tomorrow and the disposition is after 60 days. They were told they have had some cases taking a couple years. How can you have something in a legal binding contract that says have 60 days or else have to pay and still not pay after a couple years.

 

 

This is something else I don't get about ins. companies. If you file a claim, why do they raise your premium. That defeats the purpose of having ins. It is a great discourager to file a claim.

Few years back was in a small fender bender in that my car was backed into in a parking lot. My ins. company said not to file w/ us or else we will raise your premium.

 

This Saturday, snow melted on my roof causing water to leak in the garage. I had water dripping off a light bulb. Huge Fire hazard. We have shut off the electricity to the garage which also turns off some of the lights in the house. Not that big a deal but an inconvenience nevertheless. We manually lock the garage door going out and in and there are other lights that do work in the house that can cover for the ones that are shut off. So I have a leaking roof somewhere and garage ceiling damage. I am going to call the ins. company but I know they will say if you file, we will raise your premium.

I have fought with Insurance ******* since June 14th 2006 Completely other guys fault and these ********* have refused to pay all the way down the line. Finally went thru Insurance Commissioner and he ruled they had to pay. THEY DID NOT PAY AS RULED!! This was a property settlement and they want me to provide papers that have been dead for over three years and release everyone in the world from responsibility in the accident. That is not what the Commissioner Ruled. He ruled on a property dispute. Not medical or anything else!!! Back to the Commissioner!!!

Now I don't care about money I will recieve ( probally none) if they will fine these cretins enough maybe they won't do it to the next guy so quick!!

I'm not going to get into another big debate about insurance companies and claims and I'm not mad, aggravated or ticked off at anyone or etc....

But to make a claim as stated earlier is simply not true...

Dan, I hate that you have been through this ordeal, really I do, it obviously was not handled properly nor were you represented properly.

But I handle claims from minor to severe on a weekly basis. I've seen companies pay out thousands upon thousands of dollars without so much as a question. There are guys on this forum who have had their property repaired and their medical bills paid to their satisfaction.

My point is that you cannot use one bad experience and catagorically state that ALL insurance companies strive to rip you off and not pay in the event of an accident. If the policy says they are liable, then you have a case and the Insurance commissioner from your state is the correct path to getting it taken care of.

And to the one who says their rates are going up as a result of a claim. Are you sure this is what is happening. Did your agent tell you that or did the company. That is not always the case and it does depend on the company and their philosophy.

Nuf said, this could be debated all day. I'll never convince some of you, but just like every other line of work out there, there are the good (reputable) and the bad (rip offs)

Slick Spirit if I ever get to meet you I will buy the 1st round.

But I have had three accidents in the last 10 yrs that the only thing I did wrong was be there. It has turned my retirement into something I was looking forward to to a time (NOW) when I will probally have to part with my 1st Gens. The Scum of the Insurance Companies is what I have ended up dealing with every time. I'm not fond of lawyers either which probally hurts me. This last accident they have not contacted me at all since 27 May 2009. I have done everything I can on my end. Their client crossed lanes and hit me headon and was drunk. Accident report done by deputy was worse piece of paperwork I have ever seen. Deputy let his friens take him out of Ambulance where I had put him and take him home. He showed up next day and changed his story. Claimed I had crossed lanes and hit him. My Insurance seems to just want to roll over and forget it because THEY DON'T HAVE TO PAY THAT WAY reguardless of what it does to me. I had the best Libility policy I could get on a 93 work car. Couldn't see throwing money away. It has Underinsured, Uninsured and everything I could get in there. Do i have to fight this one 3 or 4 yrs and get nothing??? Tired of this S***. I'll Shut up.

I've followed your saga and I feel for ya. Yours is definately one of the horror stories out there. Just like there are horror stories about prison guards and what they have done. But that doesn't mean that all of them are that way. I know that there are guards that do it the right way every time and are upstanding and outstanding in their job. Same with insurance companies.........And I'll look forward to and accept that first round and take care of the second...........

When I deal with Convicts I just think of them as Insurance people!!:rotfl::rotfl:

 

Could not resist that one!!! I know my story is not the way it usually happens but just seems the law claims we must give them our money as long as we never want any back. Another thing you mentioned. I do have a accident on my record that was my fault. I had a S-10 (again) truck come flying pass me pulled back in my lane and slammed on his brakes. I hit him in the ass. I'm not making excuses. I hit him. My Insurance company raised my rates and told me it was to pay for damage to the truck. What is Insurance???

I called my local state farm branch. That is what they are saying. Maybe a call to the corporate office is in order, but I would like the names of companies that don't raise your premium a dime whether you submit 1 or even 100 payable claims. Whether it be home or auto. State Farm is also the company my niece has been having to deal with.

Not many agents would tell you this, but your local agent is judged by his company (ies) on his loss ratio. Many of them will try to encourage their insured's to not file a claim by telling them it will result in a rate increase. Check with the company itself.

Was your loss an "at fault" accident? I don't agree with that line of thinking, but it happens.

Talked to the corp. office last night and they told me I would have to talk to the local office about it as they don't determine rate increases.

 

As far as at fault this is in regards to a leaking roof which caused garage ceiling damage. So someone has to come out and determine normal wear/tear (not covered by policy) or due to snow and ice (covered).

 

Funny thing is they said if the local branch wasn't able to tell about a rate increase they can talk to the underwriters located in a regional office.

 

Anywho back to the normal scheduled programming.

 

Did you get new windshield and up on the road again?

Wow... I didn't mean to start anything folks; sorry :confused24:.

 

I pulled into my driveway a few hours ago. The windshield was replaced yesterday afternoon and we were on the road by 3 or 4pm. I stopped somewhere in Missouri (~20 miles west of Cuba Missouri, I think) because my girlfriend was uncomfortable about sleeping in the car, since last time she fell asleep she woke up covered in glass and ice and was numb all over...

 

I talked with a few different people at the insurance company yesterday and the last one I spoke with was actually the adjuster that will be looking at the vehicle etc sometime tomorrow. Since I helped my dad run a body shop for a number of years, I have some experience dealing with adjusters (Some were very good experiences and some were very bad experiences). My initial conversation with the local adjuster was quite positive, so I hope that he lives up to everything that we have already discussed. This guy has no idea that I have any clue about repairing vehicles, estimating damage, etc. So, I plan on keeping that aspect to myself until he gets done with his estimate or if he starts blowing smoke. So, we'll see what happens.

So I have made it home safely... Although I went to take a shower and found that I have no water... Long story short, I have a busted water pipe and water softener and a water softener shed that is soaked with water on the inside; thanks to the cold weather that west Texas got and was supposed to be at work yesterday. So... what a way to be welcomed home after the holidays... woo freaking hoo.

Glad you seem to be getting somewhere with it. I didn't mean to Hi-Jack your thread. I'm sorry about that. It just takes the word Insurance to set me off anymore.Good luck with your claim. I'm not done fighting yet.

Sounds like everything's working out and like Dan said, didn't mean to hi-jack the thread. You didn't start anything. I don't think there's any animosity in the spirited discussion we've had.

Dan (rightfully) has a reason to be upset with his insurance company. I hope he comes out a winner in his situation and wish there was something I could do to help him.

Well. Things have gone amazingly smoothly so far.

 

Yesterday I took the vehicle to the collision adjuster (that deals with vehicles). We spent about an hour or so and I walked out with a check for the initial estimated amount. With what we had discussed, and what I know about doing bodywork, etc. I know that there will be at least one or two supplements in getting this taken care of and the adjuster had mentioned the same thing to me but 'assured' me that progressive would take care of everything above my deductible, blah blah blah.

 

So far so good. I just wish I was closer to my own shop so I could do the work myself and be done with it... (mostly because I enjoy this kind of stuff)

 

I am still waiting to hear about getting reimbursed or subsidized for the rental car and hotel bill that I had to get because Progressive couldn't find me a windshield until the following Monday (the hit happend on a Saturday) but it does look promising.

 

Thus far and considering the circumstances, I do not know that things could actually move any more smoothly than they are.

 

Anyhoo, just thought I'd update anyone following along.

I think it helps that mine was pretty straight forward. ie. No claimed injuries, no other vehicles involved; pretty cut and dry.

 

I hope that your situation comes to a close, in an acceptable manner, sometime in the near future...

Glad to hear nobody w hurt, sorry I didnt hear about this sooner I am close to the area of anderson and coulda helped with the windshield for you and had it towed to the shop I work at and had you taken care of. I dont get on here as much sometimes or I would have tried to help you out. Good luck with your ins stuff!!
