oldgoat Posted December 18, 2009 Share #1 Posted December 18, 2009 sad as it might be i might have to give the venture back to the loan company:bawling:. i was injured on a job last year after i got a loan to purchase the bike, been fighting the so called workers comp. well im still out of work. and was forced to retire from that job of over 15 years . there story was your no longer able to perform your duties. funny they dont want to settle? any ways i had to borrow against the bike once again. was doing ok as i was getting workcomp checks then they stopped due to there doctor saying things if anyone has fought workers comp you know where im comming from. im in a long fight with this as it destroyed my left knee. i had insurance to cover the loan if im out of work or dissabled. but due to the workers comp doc saying i can do light duty work. im screwed. my doctor says he cant work. till the knee is totaly healed. im stuck between a rock and a hard place now i owe $6000. on the bike total intrest and all. i love the bike but cant make the 200 a month payments yikes i know that high payments. also 300 for the car 300 for rent and ect ect im down to minus 150 a month with out makeing the bike payment. and noone will hire this old goat with all my restrictions. might not be the place to vent this but i like all of you and found a great friendship here Link to comment Share on other sites More sharing options...

They dicked me around something horrible until I took a friends advice and got a Lawyer. THAT stopped it right away. The state had to retrain me for a job that I CAN do, for a comperable salary. I have now worked my way up in salary to 3x what I was making for the state. - Something I NEVER could have done if I had stayed there. I hope you have a Lawyer. GlennTuc Posted December 18, 2009 Share #4 Posted December 18, 2009 My wife just went through the whole routine you're talking about. Dealing with workman's comp is no fun. Two months after she got hurt the workman's comp doc told her she could go back to work; however, three other doctors told her not to go. Workman's comp quit paying her because their doc said she could work, just do light duty or get a different job. The workman's comp rep even told her she would have to get a different job. To make a long story short. it took two years to get it settled and she is 100% disabled. She's even drawing SS disablity. Workman's comp is a good thing when they are helping, but can be a nightmare to manage. They've made a lot of lawyers rich dealing with them. I wish you luck and if possible, don't get in a hurry dealing with them cause I truely believe their primary strategy is to starve you out and force you to settle with them for a lot less than you are owed and deserve. Once you're back on you feet, and your life has settled down, there will be plenty of 1stGen MKII's available selling for a lot less. Also go get a lawyer and sue the cr*p out of them. We tried very hard not to get a lawyer, but when I finally said I was tired of getting jerked around by them, I said you got one more chance before I quit talking and let a lawyer to handle it. I finally was assigned an agent that was willing to work with us. Laura has had four surgeries associated with the area around her right eye. She had what is called an eye socket bloweye. She still has to wear special glasses with prisim lens for double vision. They made an offer we had basically agreed to that I had a lawyer review. He said that's was the best she would probably get. I was notified yesterday that after they sent the proposal thur their lawyers, they upped it over $7,000 more. Go figure. The problem with workmans comp is you are dealing with two intities. Each state has their own laws and then they are paying premiums to a private insurance company, in her case Liberty Mutual. Obviously, the less an insurance company pays, the more profit they make. My best advise is to get a good doctor that is willing to assign a good impairment rating and then present WC with that and also visit a good lawyer that deals in WC on a free visit for a review. Once you offically put it in the lawyers hands, WC will no longer talk to you. Good luck and I can assure you that this can be a miserable experience, but DO NOT give up. I've been out of work for almost a year and the savings are going fast. The only reason I still have my bike is that it's paid for and more dependable than my van. I'll be praying for you brother. Shamue Posted December 18, 2009 Share #10 Posted December 18, 2009 If you haven't yet talked to an attorney, look in the phone book for a workman's comp. attorney. They are usually paid through workmans comp. and it should not cost you anything when it is a legitimate claim with doctors involved. In NM the attorney fees do not decrease the anoumt of settlement. Results can still take time, but an attorney may be able to get your workman comp. payments started again. Remember, workmans comp. insurance cost to an employeer are figured yr. to yr. based on the inheriat work dangers and then the claims filed. Employer's workmans comp. insurers play had ball to keep the cost/payments down to be competive and not loose business. Sorry you having such a had time, Good Luck, and don't let them ware you out.
