Well noone let us know but I was looking at the court records last night aand this suddenly appeared :

 

Docket Entry:Bndover Circ-Waive Prel Hrng

 

Text: State appears by Asst. P.A. Defendant appears in person and by attorney. The Court finds that Defendant has been advised of his/her rights & enters a valid waiver of preliminary hearing; the Court orders that the Defendant appear and be present in Division One of the Circuit Court of Clay County for arraignment.

 

Associated Docket Entries: 11/04/2008 - Hearing Continued/Rescheduled

 

Associated Docket Entries: 11/04/2008 - Hearing Scheduled

 

Associated Events: 11/18/2008 , 09:00:00 - Hearing

 

 

apparently he waived his preliminary hearing and we finally have him in the circuit court..:D..new judge, new court room ( finally in criminal court )

Of course i plan to call prosecutor today and see what they have to say.

This means we can get his dna ordered........

if i understand right ..he now gets to make a plea again next tuesday.....

if he pleads not guilty again....we start moving on to a trial......

I intedn to find out if there has been anything said about a plea bargain at all.....

I really wish it wouldnt have to go to trial but with a plea bargain we would have to give in a little and that would be hard to do

 

I also had to laugh....as i was looking thru the cases for the 18th in the court div we had been in...lo and behold shows up his sisters name ( the mother of the girl Haylie played with at their ( his parents and his) house.) Anyways looks like she is in a lil trouble herself.....Possession Of Up To 35 Grams Marijuana

pretty ironic a brother and sister both in court the same day---------need i say more???

We are glad you guys are finally starting to move forward with this. Hopefully you get a better judge, a no nonsense judge who will put this guy away.

 

Sounds like a real winner of a family there. A Brother and Sister in the same court the same day for different crimes.

Best of luck to you in and out of court. Not sure I'd be open to plea bargaining, unless it was on how deep to bury this guy to allow sunlight to get to him.

 

As for the sister also, sounds like a 'great' family.

Thanks for the update....we are all standing by to cheer when gets his due! Of course that will be nothing compared to what awaits him when he meets his maker!

Thanks for the update CIndy.

My view on a plea bargain is that it might save H from having to testify, (but sometimes thats part of the healing for them).

 

As long as it's not a stupidly lenient deal, I might consider it, you never know what these juries will do.

 

Still thinking of you guys often.

well sudden change.........and if i hadnt looked at the court records I wouldnt have known.....

 

Date for the hearing was changed from the 18th to tomorrow.....

 

Agravates me they didnt let me know.....I had to call the PA to check on it........they finally just called me back.

Guess I better keep tabs daily to stay ahead of the game..

 

I know all its going to be is another not guilty plea and the request for a swab ( dna) but I wouldnt miss it for nothing !:cool10:

Gonna be tough on dale as he works tonight and will be lucky to get 2 or 3 hrs sleep before we go.....usually the hearings have been on Tuesdays and he doesnt work mon night.

will be thinking good thoughts for dale and you ..keep the faith.. Remember you will be the victors in the end of this battle .. Ill say a prayer for strength for you guys..keep us informed...stay cool....

pa put in a motion for discovery and a motion to compel buccal swab samples ( for dna)

which will be argued next thursday at 1:30

 

and of course he pled not guilty again.

 

His lawyer wasnt there when they called the case and the perp said he hadnt talked to him all week so judge took a 5 min break..more like 15..lol

his lawyer finally showed up said he was at the jail looking for him...now wouldnt he know his client would be at the court.....:think:

 

anyways..we are starting to wonder about his lawyer.....cpl weeks ago he never showed?/

You cant imagine what happens to your mind and body in there.....

they finally bring him in and when you see him your heart starts pounding and you tense up and fill with anxiety......the adrenalin starts pumping and you want to do something.or say something......but you cant.

Cindy, the problem with him being a worthless lawyer is that it gives room for a later appeal. Have ya'll thought about suing civilly. I know you dont want blood money on your daughter, but money is the way to hurt them the worst sometimes and later it could be used for college or whatever. I also know how Dale feels. In over 20 years of police work I worked dog shift most of my career and spent many hour and days in court after working all night. Sometimes several days a week went like that, and people wonder why cops are in bad moods. I wish you and Haylie and the rest of your family all the best and that the scumbag gets his just due in prison. The pecking system there does not like his kind. Lyle
